Se ordenó al Tribunal respectivo dar el trámite debido a la impugnación que el actor interpuso oportunamente en contra del fallo de tutela proferido en primera instancia por el Juzgado de la referencia, toda vez que el Art. 228 de la Carta Política establece que en las actuaciones de la Administración de Justicia "prevalecerá el derecho sustancial", y el Art. 31 ibídem señala que "toda sentencia judicial podrá ser apelada o consultada, salvo las excepciones que consagre la ley".
En consecuencia, se regresó el expediente para que proceda el trámite de la segunda instancia y posteriormente esta Corte haga su eventual revisión.

- Primero. ORDENAR al Tribunal Superior de Medellín, Sala Laboral, que dé el trámite debido a la impugnación que el actor, Manuel Eyvin Ayala Mosquera, interpuso oportunamente en contra del fallo de tutela proferido en primera instancia por el Juzgado
- Décimo. Laboral del Circuito de Medellín el 19 de enero de 1998.
- Segundo. ORDENAR a la Secretaría General que, una vez regrese a la Corte el presente expediente, sea remitido a la Sala Cuarta de Revisión de Tutelas, a fin de que se pueda realizar la revisión, puesto que ella no procede mientras esté pendiente el trámite de la segunda instancia.
